Acceptable Use Policy

EREBYX products, services, and technologies

This Acceptable Use Policy covers the products, services, and technologies (collectively the "Products") provided by EREBYX LLC under any ongoing agreement. It's designed to protect us, our customers, and the general Internet community from unethical, irresponsible, and illegal activity.

EREBYX customers found engaging in activities prohibited by this Acceptable Use Policy can be liable for service suspension and account termination. In extreme cases, we may be legally obliged to report such customers to the relevant authorities.

Age Requirement

EREBYX is for adults 18 years of age and older. You may not create an EREBYX account or use EREBYX services if you are under 18.

Separately, we do not knowingly collect personal information from children under 13, in compliance with the U.S. Children's Online Privacy Protection Act (15 U.S.C. §§ 6501-6506). If we discover such collection, we delete it.

If we discover that an account holder is under 18, we terminate the account and delete the associated personal information. Parents or guardians who believe their child has created an account may contact [email protected] for immediate removal.

Fair Use

We provide our facilities with the assumption your use will be "business as usual," as per our offer schedule. If your use is considered to be excessive, then additional fees may be charged or capacity may be restricted.

We are opposed to all forms of abuse, discrimination, rights infringement, and any action that harms or disadvantages any group, individual, or resource. We expect our customers and, where applicable, their users ("end-users") to engage our Products with similar intent.

Customer Accountability

We regard our customers as being responsible for their own actions as well as for the actions of anyone using our Products with the customer's permission. This responsibility also applies to anyone using our Products on an unauthorized basis as a result of the customer's failure to put in place reasonable security measures (including safeguarding API keys).

By accepting Products from us, our customers agree to ensure adherence to this policy on behalf of anyone using the Products as their end users. Complaints regarding the actions of customers or their end-users will be forwarded to the nominated contact for the account in question.

If a customer — or their end-user or anyone using our Products as a result of the customer — violates our Acceptable Use Policy, we reserve the right to terminate any Products associated with the offending account or the account itself or take any remedial or preventative action we deem appropriate without notice. To the extent permitted by law, no credit will be available for interruptions of service resulting from any violation of our Acceptable Use Policy.

Prohibited Activity

Illegal Content

Our Products must not be used to transmit, distribute, or store any material in violation of any applicable law. This includes:

  • Child sexual abuse material (CSAM), grooming material, or content sexually exploiting minors
  • Content depicting non-consensual intimate imagery
  • Content facilitating human trafficking, sexual exploitation, or violence against children
  • Content that violates US federal law, North Carolina state law, or applicable state law where you reside
  • Material protected by copyright, trademark, trade secret, or other intellectual property right used without proper authorization
  • Material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws

As a U.S.-based Electronic Service Provider, EREBYX is required by 18 U.S.C. § 2258A to report suspected child sexual abuse material to the National Center for Missing and Exploited Children (NCMEC) CyberTipline at report.cybertip.org. Per § 2258A(a)(1), reports are filed as soon as reasonably possible after detection. Per § 2258A(h)(1), EREBYX preserves reported material and related metadata for 90 days (extendable on NCMEC or law-enforcement request) to enable investigation.

Harm to Others

Our Products must not be used to:

  • Threaten violence against any person
  • Harass, stalk, dox, or intimidate any person
  • Promote hate speech targeting individuals based on race, ethnicity, religion, gender identity, sexual orientation, disability, or national origin
  • Facilitate self-harm or suicide
  • Engage in coordinated harassment or brigading

Spam and Unauthorized Message Activity

Our Products must not be used for the purpose of sending unsolicited bulk or commercial messages in violation of the laws and regulations applicable to your jurisdiction ("spam"). This includes sending spam, soliciting customers from spam sent from other service providers, and collecting replies to spam sent from other service providers.

Our Products must not be used for the purpose of running unconfirmed mailing lists or telephone number lists. All messaging lists run on or hosted by our Products must be "confirmed opt-in." Verification of the address or telephone number owner's express permission must be available for the lifespan of the messaging list.

We prohibit the use of email lists, telephone number lists, or databases purchased from third parties intended for spam or unconfirmed messaging list purposes on our Products.

Our Own Email Practices (CAN-SPAM)

The standards above set what we expect from customers. We hold ourselves to the same standard. EREBYX complies with the U.S. CAN-SPAM Act (15 U.S.C. § 7701 et seq.) for our own outbound email:

  • Transactional email (welcome, receipt, payment-failed, account verification, security notices, breach notification) is sent via MailerSend. These messages are required to deliver the service and cannot be unsubscribed from while you have an active subscription — cancel via the Stripe Customer Portal to stop transactional email.
  • Marketing email (newsletter, product updates, "The Signal") is sent via MailerLite, only to recipients who have explicitly opted in. Every marketing message includes a one-click unsubscribe link and our valid postal address.
  • We honor opt-out requests within 10 business days as required by CAN-SPAM. We do not transfer opt-out lists to third parties.
  • Our valid postal address for CAN-SPAM purposes: EREBYX LLC, 500 Westover Drive #32317, Sanford, NC 27330, USA.

Unethical, Exploitative, and Malicious Activity

Our Products must not be used for the purpose of advertising, transmitting, or otherwise making available any software, program, product, or service designed to violate this Acceptable Use Policy. This includes facilitating means to send spam and the initiation of network sniffing, pinging, packet spoofing, flooding, mail-bombing, and denial-of-service attacks.

Our Products must not be used to access any account or electronic resource where the group or individual attempting to gain access does not own or is not authorized to access the resource (e.g. "hacking," "cracking," "phreaking," etc.).

Our Products must not be used for the purpose of intentionally or recklessly introducing viruses or malicious code into our Products and systems.

Other prohibited activities:

  • Obtaining (or attempting to obtain) services from us with the intent to avoid payment
  • Using our facilities to obtain (or attempt to obtain) services from another provider with the intent to avoid payment
  • The unauthorized access, alteration, or destruction (or any attempt thereof) of any information about our customers or end-users
  • Using our facilities to interfere with the use of our facilities and network by other customers or authorized individuals
  • Publishing or transmitting any content or links that incite violence, depict a violent act, depict child pornography, or threaten anyone's health and safety
  • Any act or omission in violation of consumer protection laws and regulations
  • Any violation of a person's privacy

Our Products may not be used by any person or entity involved with or suspected of involvement in activities or causes relating to illegal gambling, terrorism, narcotics trafficking, arms trafficking, or the proliferation, development, design, manufacture, production, stockpiling, or use of nuclear, chemical, or biological weapons, weapons of mass destruction, or missiles.

Specific to AI Counterparts

Because EREBYX is memory infrastructure used in conjunction with AI counterparts, additional rules apply:

  • Do not store memories designed to manipulate, jailbreak, or compromise the safety properties of underlying AI models you use EREBYX with
  • Do not use EREBYX to facilitate violations of your AI provider's terms of service (Anthropic, OpenAI, etc.)
  • Do not store memories that, when retrieved, would cause your AI counterpart to generate content that violates this AUP
  • Do not store personal data of third parties without their explicit consent
  • Do not store regulated data (medical, financial, government, etc.) you aren't authorized to handle

Unauthorized Use of EREBYX Property

We prohibit the impersonation of EREBYX, the representation of a significant business relationship with EREBYX, or ownership of any EREBYX property (including our Products and brand) for the purpose of fraudulently gaining service, custom, patronage, or user trust.

Reporting Violations

To report violations of this policy, email [email protected] with subject line "AUP REPORT" and include:

  • A description of the content or behavior
  • The account or memory ID if known (without sharing prohibited content directly)
  • Your contact information

We respond to AUP reports within 48 business hours. Reporter identity is kept confidential except where disclosure is required by law or law-enforcement process.

For suspected CSAM: report directly to NCMEC at report.cybertip.org. We are required by federal law to use this channel as the primary reporting path.

Enforcement

Violations of this AUP may result in:

  • Warning and required content removal
  • Temporary account suspension (24 hours, 7 days)
  • Permanent account termination
  • Reporting to law enforcement (where required by law, including NCMEC reporting per § "Illegal Content")

Refund posture on termination. Account terminations for AUP violations forfeit any unused subscription period without refund (per our Refund Policy). Where EREBYX initiates a termination without cause (e.g., we discontinue a service tier), prepaid amounts are likewise non-refundable except where a refund is required by applicable law.

We exercise enforcement judgment. Borderline cases are handled with warnings first; severe violations (CSAM, doxxing, threats, fraud) result in immediate termination without warning.

About This Policy

This policy outlines a non-exclusive list of activities and intent we deem unacceptable. We reserve the right to modify this policy as our service, the law, and the threat landscape evolve.

Notice of material changes. We will notify you of material changes to this AUP via the email address on your account at least 30 days before the changes take effect. Continued use after the effective date constitutes acceptance. Non-material changes (typo fixes, clarifications, link updates) become effective on publication.
