Refund Policy

This Refund Policy describes how EREBYX LLC handles refunds, cancellations, and the trial period for Genesis Arche subscriptions. It supplements our Terms of Sale.

the trial (Days 0–7) — your no-charge window

Marketing surfaces refer to this 7-day trial period as the "7-day experience." The legal term is "trial" as defined below.

When you start a Genesis Arche subscription, your card is required at signup but not charged during the trial period. The first 7 days are the trial — a 7-day no-charge window inside EREBYX before any payment is taken. The 7-day trial is your window to decide: cancel before Day 8 and you are never billed.

If you cancel during the trial: no charge ever happens. There is nothing to refund. Your seat returns to the available pool of the 2,000-seat Genesis Arche cohort. Your data is deleted per the standard retention policy after the 30-day grace period.

To cancel during the trial: visit your billing dashboard (which wraps the Stripe Customer Portal) or use the link in your welcome email. No questions asked, no friction, no nag.

After the trial (Day 8+)

On the 8th day after signup, your card is charged for your first month ($179.00) or year ($1,790.00) per your selected plan. After that, charges occur monthly or annually based on your plan.

Charges already processed are non-refundable and are not prorated. Your 7-day trial is your no-charge window — that is the time to decide whether EREBYX is right for you. If something isn't working, reach out to [email protected] — we read every message and want to make it right.

Sales tax. Software-as-a-service is generally not subject to sales tax in most U.S. jurisdictions, including North Carolina. Stripe Tax automatically calculates and adds tax at checkout only for jurisdictions that do tax SaaS. The amount you owe is shown clearly on every receipt.

When you cancel after the trial: you keep full access through the end of your current billing cycle, then no future charges occur. Your data remains accessible during the 30-day grace period after cancellation; full deletion follows the retention policy.

No refunds after the trial

We keep this simple: the 7-day trial is the only no-charge window, and it's a generous one. Card in, no charge for a full week, cancel anytime before Day 8 and you're never billed. That's your space to decide.

Once a charge is processed on or after Day 8, it is non-refundable and not prorated — there are no refunds or credits. Canceling stops future renewals; you keep full access through the end of the period you've already paid for.

This is the same posture stated in our Terms of Sale § 7; the two documents read consistently. Nothing here limits any non-waivable rights you may have under applicable law.

Annual Subscription Refunds

Annual Genesis Arche subscriptions ($1,790/year — equivalent to $179 × 10 months, i.e. two months free when paid annually; sales tax may apply per the framing in "After the trial" above) are non-refundable once the trial converts on Day 8. As with monthly, the 7-day trial is your no-charge window to decide before any annual charge is taken.

If you cancel mid-year: you retain full access through the end of your annual billing period (the date one year after your initial Day 8 charge). No future charges occur. The unused portion of the prepaid year is not refunded on voluntary cancellation.

Chargebacks & Billing Inquiry SLA

If you have a billing concern, please contact [email protected] first — we resolve nearly all billing concerns directly without chargeback. We respond to billing inquiries within 2 business days. If you have not heard from us within that window, please reply to your original message to escalate.

If you initiate a chargeback through your card issuer without first contacting us, your account will be suspended pending resolution. We respond to all chargeback disputes with documentation of service usage and the disclosures from these Terms. Chargebacks for charges that were properly authorized and disclosed (including auto-conversion on Day 8 of the trial) may result in account termination.

Account Termination by EREBYX

If we terminate your account for cause (material breach of these Terms, our Terms of Service, our Acceptable Use Policy, fraud, or chargeback abuse), you forfeit any unused subscription period without refund, except where required by law.

If we terminate your account without cause (for example, if EREBYX discontinues the service), prepaid amounts are non-refundable except where a refund is required by applicable law. If we ever wind down the service, we'll give you advance notice and an export window so you can take your data with you.

Data Export Always Available

Whether or not you cancel, you can export all your data as JSON at any time via dashboard → Settings → Export. Your memories and metadata are yours. Cancellation does not delete your ability to export — it deletes the data after the 30-day grace period.

Genesis Arche Rate-Locked Promise

Your Genesis Arche subscription rate is locked at the price in effect at your time of subscription and remains locked for as long as your subscription remains continuously active. "Continuously active" is defined in Terms of Sale § 6 — in short, no gap of more than 30 days between successful payments, with Stripe payment-recovery dunning of up to 21 days preserving continuity.

Cancellation does not automatically forfeit your locked rate. If you cancel after the trial, you have a 30-day reactivation grace period during which you may reactivate at your previously locked Genesis Arche rate, provided that Genesis Arche cohort seats remain available at the time of reactivation. After 30 days — or if the 2,000-seat cohort fills before you reactivate — your locked rate is permanently forfeited and re-subscription is at then-current published rates.

This grace period is for seat preservation, not refunds. Fees already paid are not refunded as a function of the grace period; the trial (§ above) is your no-charge window to decide before any payment is taken.
